These Terms & Conditions govern use of the Original Biskra Dates website and the submission of business enquiries. They are written for professional and business users. A quotation request or sample request is not an order, and these website terms do not replace the specific commercial terms contained in an accepted quotation, order confirmation or sales agreement.

The website provides preliminary B2B information. Product specifications, grades, availability, pricing, payment, packaging, freight, documents, delivery estimates and responsibilities are confirmed separately for each transaction. No sale is formed merely by using the website or submitting a form.

Original Biskra Dates is the customer-facing brand used to present products and manage business enquiries. EURL TCHEK SIM EXPORT is the legal Algerian exporter unless a written quotation or contract identifies another seller or contracting entity.

2. Acceptance and permitted use

By using the website, the visitor agrees to comply with these website terms. The website may be used for lawful business research, product enquiries and communication with Original Biskra Dates. Users must not attempt to damage the site, bypass security, submit false information, impersonate another person or company, upload malicious files, scrape the site at an unreasonable rate or use the content for unlawful or misleading purposes.

If a user does not agree with these terms, the user should not use the forms or rely on the website content.

3. Business-to-business purpose

The website is intended primarily for importers, wholesalers, distributors, retailers, food-service businesses, manufacturers, repackers and other professional buyers. It is not an online consumer shop, and no consumer checkout or automatic order facility is provided.

4. Website information and no binding offer

Product descriptions, photographs, packaging examples, logistics explanations, harvest information and other content are general information intended to support an initial business discussion. They do not constitute a binding offer, warranty, specification sheet or guarantee of stock, price, certification, freight route or delivery date.

Although reasonable efforts are made to keep information accurate, natural agricultural products and commercial availability can vary. The current product, lot, grade, specification, packaging, documents and commercial terms are those confirmed in writing for the relevant quotation or order.

5. Enquiries, forms and communications

Submitting a quotation, sample or contact form only asks us to review the request. Submission does not oblige us to provide a quotation, reserve stock, send a sample or accept an order. We may request additional information, verify the company or decline an enquiry where information is incomplete, the request is not commercially feasible or legal or compliance concerns arise.

The person submitting information confirms that it is accurate to the best of their knowledge and that they are authorised to communicate on behalf of the named company where applicable.

6. Samples

Samples are subject to product availability, business verification, destination feasibility and agreement on courier or freight cost. A sample may not be identical in every natural characteristic to a later commercial lot. A sample is provided for reasonable business evaluation and may not be resold or represented as a guaranteed specification unless expressly agreed in writing.

Any charge, shipping cost, customs responsibility or delivery estimate for a sample will be confirmed before dispatch.

7. Quotations and validity

Quotations are prepared individually and may state product, grade, quantity, packaging, price, currency, Incoterm, freight assumptions, payment terms, validity period, estimated preparation time, documents and other conditions. A quotation may be withdrawn or revised before acceptance if stock, freight, exchange rates, legal requirements, supplier costs or other relevant circumstances change.

A quotation is valid only for the period and assumptions stated in it. If no validity period is stated, availability and price must be reconfirmed before acceptance.

8. Formation of a sales contract

A binding sales contract is formed only when the authorised parties agree the commercial terms in writing and the seller issues or accepts the relevant order confirmation, pro forma invoice, sales agreement or other written confirmation. Payment of a required deposit may constitute acceptance where the quotation expressly states this.

If there is a conflict, the signed sales agreement or accepted order confirmation takes priority, followed by the accepted quotation, any incorporated sales terms and then these website terms.

9. Natural product characteristics and specifications

Dates are natural agricultural products. Reasonable variation may occur between seasons and lots in size, colour, translucency, softness, moisture, skin condition, shape, branch appearance and other natural characteristics. Product photographs are illustrative and screen settings may affect colour representation.

Grades such as Premium, Standard, Economy and Industrial describe commercial selection levels, but final tolerances, defect limits, count or size range, moisture, packaging and acceptance criteria must be confirmed in the quotation or product specification. Where branch dates are supplied, branch quality and presentation may also form part of the agreed grade.

10. Certificates and documentation

Relevant product, laboratory, origin, export and customs documents may be available depending on the product, lot, order and destination. References to Organic, ISO, HACCP, Halal or other certification mean only that supporting documentation may be available where applicable and confirmed; they do not guarantee that every product, facility, lot or order carries every certification.

The buyer must state required documents before order confirmation. Documents that are not expressly confirmed in writing are not included by default.

11. Prices, currency, taxes and charges

No public website price is binding. Prices are quoted according to product, grade, quantity, packaging, private-label requirements, freight, destination, currency and market conditions. Unless the quotation states otherwise, prices exclude import duties, destination taxes, customs charges, inspection fees, bank fees, storage, demurrage and other destination-side costs.

The buyer is responsible for reviewing the quotation and asking about any cost that is unclear before acceptance.

12. Payment

Payment terms are stated in the quotation or pro forma invoice. Unless otherwise agreed in writing, the standard commercial arrangement may be a 30% deposit to confirm the order and the remaining 70% before shipment. Different terms may be considered for established long-term partners.

Orders may not enter preparation, be released or be shipped until the required payment has cleared. The buyer is responsible for using the verified bank details shown on the official invoice and should independently confirm any unexpected request to change payment details.

13. Packaging, labels and private label

Available formats may include 500 g, 1 kg, 2 kg, 5 kg and bulk packaging, subject to the product and order. Carton configuration, pallet arrangement, materials, artwork, languages and label content are confirmed for each order.

For private-label or custom packaging, the buyer must provide accurate and lawful artwork and market information. The buyer remains responsible for confirming that the final brand claims, translations, nutrition information, legal name, importer details, recycling marks and other destination-market label elements meet applicable requirements, unless a written agreement assigns a specific responsibility differently.

Production of custom packaging may require artwork approval, minimum quantities, deposits and additional lead time. Changes after approval may result in extra cost or delay.

14. Freight, Incoterms, delivery and risk

Sea freight and air freight may be discussed depending on quantity, urgency, route, port or airport access and destination. Transit and preparation times are estimates, not guaranteed delivery dates, unless a separate written commitment expressly states otherwise.

Commercial terms such as EXW, FOB or CIF may be used case by case. Where a quotation expressly refers to an Incoterm, it is interpreted according to the version stated in the quotation. The agreed term determines the parties’ responsibilities for delivery point, freight, insurance, export, import, costs and transfer of risk.

Delays may arise from production, documentation, inspections, carrier schedules, congestion, weather, customs, border controls, force majeure or acts of third parties. We will provide reasonable updates but are not responsible for matters outside the agreed responsibility and reasonable control of the seller.

15. Buyer import and compliance responsibilities

Unless the accepted contract states otherwise, the buyer is responsible for verifying whether it may lawfully import, market, store and sell the products in the destination country. This includes licences, registrations, importer-of-record status, food-law requirements, labelling, language, customs classification, duties, taxes, inspections, sanitary or phytosanitary requirements and any destination-specific restrictions.

Information provided by Original Biskra Dates is commercial assistance and does not replace advice from the buyer’s customs broker, food-law adviser, authority or other professional adviser.

16. Inspection, acceptance and claims

The buyer should inspect samples and commercial shipments promptly and in accordance with the accepted quotation or sales terms. Any visible shortage, transit damage, packaging issue or apparent non-conformity should be recorded with the carrier where relevant and notified promptly with photographs, lot details, quantities and supporting documents.

The applicable claim period, inspection method and remedy are those stated in the sales contract. Products should be stored correctly and preserved for reasonable inspection while a claim is reviewed. No return, disposal, rework or deduction should be made without written agreement where the seller is expected to bear the cost.

17. Order changes and cancellation

Requests to change or cancel an accepted order are subject to written approval. Costs already incurred for product allocation, printing, custom packaging, laboratory work, documentation, freight booking or other preparation may remain payable. Custom or private-label work may become non-cancellable once production or printing begins.

18. Events outside reasonable control

Neither party is responsible for delay or failure caused by events outside its reasonable control, including extreme weather, crop disruption, fire, flood, epidemic, war, civil disturbance, sanctions, embargo, government action, port closure, carrier cancellation, labour disruption, cyber incident or infrastructure failure. The affected party should notify the other party where reasonably possible, and the parties should discuss a practical adjustment, suspension or cancellation depending on the circumstances.

19. Intellectual property

The Original Biskra Dates name, logo, website design, text, layout and owned product imagery are protected by applicable intellectual-property laws. They may not be copied, republished, altered, used in advertising or presented as another business’s material without written permission.

Some country photographs or other media may be licensed from third parties and remain subject to the relevant owner’s licence. No website use transfers ownership of any intellectual-property right.

20. Files and content submitted by users

A user uploading artwork, specifications or other material confirms that they have the right to provide it and that its intended use will not infringe third-party rights or law. The user grants the limited permission needed to review the request, prepare a quotation and, if agreed, carry out the packaging or order project.

We may reject or delete files that are unlawful, malicious, irrelevant, technically unsafe or not needed for the enquiry.

21. Third-party websites and services

The website may link to external sites or rely on third-party hosting, email, freight or other services. External services are governed by their own terms and privacy notices. A link does not constitute endorsement or a guarantee of availability, accuracy or security.

22. Disclaimer and limitation relating to website use

The website is provided on an “as available” basis for preliminary business information. To the maximum extent permitted by applicable law, we do not accept responsibility for decisions made solely on unconfirmed website information, temporary unavailability, third-party content, or indirect or consequential loss arising only from use of the public website.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or deliberate misconduct. Liability arising from a sale is governed by the accepted sales contract and mandatory law rather than by this website disclaimer alone.

23. Privacy and cookies

Personal data and browser storage are handled as described in the Privacy Policy and Cookie Policy. Those policies form part of the website information and should be read before submitting an enquiry.

24. Governing law and disputes

The governing law, jurisdiction or dispute-resolution method for a product sale will be stated in the accepted quotation, order confirmation or sales agreement. If those documents are silent, the applicable rules must be determined from the circumstances and mandatory law.

The parties should first attempt to resolve any commercial disagreement through good-faith written discussion. Nothing in these terms restricts rights that cannot lawfully be waived or the authority of a competent regulator or court.

25. Changes, severability and contact

These website terms may be updated to reflect legal, technical or business changes. The version published when the visitor uses the website applies to that website use; a later update does not automatically change an already accepted sales contract.
